Terms of Service

1. Acceptance of Terms

By creating an account or using Vulcain VPN ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

These terms constitute a legally binding agreement between you and Vulcain VPN.

2. Account Registration

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account

You are responsible for all activity that occurs under your account.

3. Fair Use Policy & Device Limits

Each subscription allows up to 3 simultaneous device connections.

Connection Monitoring

To enforce this limit and prevent fraud, we monitor connection metadata including:

• IP addresses of connected devices
• Connection timestamps
• Approximate geographic location (city/country)

This data is automatically deleted after 24-48 hours. See our Privacy Policy for details.

Account Sharing Prohibited

Sharing your account credentials with others is strictly prohibited.

Each subscription is for personal use only. You may connect up to 3 of your own devices simultaneously, but you may not:

• Share your username and password with friends, family, or colleagues
• Allow others to use your account credentials
• Use your account from multiple countries simultaneously (this triggers security alerts)

Security Measures

We employ automated security systems to detect:

• Password theft – If your account is used from multiple countries at the same time, all connections will be terminated and your account temporarily locked for investigation
• Excessive connections – Attempting to connect more than 3 devices simultaneously will result in the oldest connections being terminated
• Suspicious activity – Unusual patterns may trigger automatic security measures

Account Suspension

Violations of the fair use policy may result in:

• Temporary account suspension for investigation
• Permanent account termination for repeated violations
• No refund for suspended or terminated accounts due to policy violations

4. Acceptable Use

You agree to use the Service only for lawful purposes. Prohibited uses include:

• Any illegal activities, including but not limited to copyright infringement, hacking, harassment, fraud, or distribution of malware
• Activities that violate laws in your jurisdiction or the jurisdiction where you're connecting
• Excessive bandwidth usage that degrades service quality for other users
• Running public servers, torrenting copyrighted material, or hosting content through the VPN
• Attempting to bypass, disable, or interfere with security features of the Service
• Reverse engineering, decompiling, or attempting to extract source code from our applications

You are solely responsible for ensuring your use complies with all applicable laws. We do not endorse or permit illegal activities.

5. Subscription & Payment Terms

Billing

• Subscriptions are billed in advance on a monthly or annual basis
• All payments are processed securely through Stripe
• Prices are subject to change with 30 days' notice
• All fees are non-refundable except as required by law

Failed Payments

If payment fails:

• Service access will be suspended immediately
• Your account data will be retained for 30 days
• After 30 days, your account may be deleted permanently

6. Service Limitations & Disclaimers

No Uptime Guarantee

We do not guarantee 100% uptime, uninterrupted service, or specific connection speeds. Service may be interrupted for:

• Scheduled maintenance (announced in advance when possible)
• Emergency security updates
• Infrastructure issues beyond our control
• DDoS attacks or other malicious activity

Geo-Restricted Content

We do not guarantee access to geo-restricted content (e.g., streaming services, region-locked websites). Many services actively block VPN traffic, and we cannot guarantee bypass of such restrictions.

Banking & Financial Apps

Important: Many banking apps, financial services, and payment platforms restrict or block VPN connections for security reasons. We do not guarantee that the Service will work with:

• Online banking websites and mobile apps
• Payment processors (PayPal, Stripe, etc.)
• Cryptocurrency exchanges
• Trading platforms

Your financial institution may flag, block, or suspend your account if you access it via VPN. Use at your own risk.

Censored Countries

In countries with strict internet censorship or national firewalls (e.g., China, Iran, UAE), governments may actively detect, block, or interfere with VPN traffic. We do not guarantee service functionality in such jurisdictions.

Using a VPN may be illegal in some countries. You are responsible for understanding and complying with local laws.

7. Subscription Expiration & Renewal

When your subscription expires:

• Service access is immediately suspended
• You cannot connect to VPN servers
• Your account and devices remain registered

When you renew or purchase a new subscription:

• Your existing devices are automatically linked to the new subscription
• You can immediately reconnect without re-registering devices
• Previous connection history is not retained (48-hour deletion policy)

8. Termination

We may suspend or terminate your account immediately, with or without notice, if you:

• Violate these Terms of Service
• Engage in fraudulent activity or payment chargebacks
• Share your account credentials with others
• Use the Service for illegal activities
• Cause harm to our infrastructure or other users

Terminated accounts are not eligible for refunds.

Effect of Termination

Upon termination:

• Your access to the Service is immediately revoked
• Your account data is retained for 30 days, then permanently deleted
• Connection logs are deleted within 48 hours per our privacy policy

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted, secure, or error-free service
• Promises of specific speeds, privacy levels, or access to content

We make no warranties about the accuracy, reliability, or completeness of the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VULCAIN VPN SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Unauthorized access to your data or accounts
• Actions taken by third parties (ISPs, governments, websites)
• Interruption, errors, or service downtime

Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Vulcain VPN harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms or applicable laws
• Your violation of third-party rights

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via:

• Email notification to your registered address
• Prominent notice on our website
• In-app notification (if applicable)

Changes take effect 30 days after notification. Continued use of the Service after changes constitutes acceptance.

If you don't agree to updated Terms, you must cancel your subscription before the changes take effect.

13. Governing Law & Dispute Resolution

These Terms are governed by French law. Any disputes will be resolved in the courts of France.

For EU consumers: You retain the right to bring claims in your country of residence under consumer protection laws.
